User Agreement

Welcome to Hynexis. This User Agreement ("Agreement") governs your use of the Hynexis mobile application ("App"). By downloading, installing, or using the App, you agree to be bound by this Agreement.

1. Acceptance of Terms

By accessing or using Hynexis, you acknowledge that you have read, understood, and agree to be bound by this Agreement and our Privacy Policy. If you do not agree to these terms, you must not use the App.

2. Eligibility

You must be at least 18 years old to use Hynexis. By using the App, you represent and warrant that you are at least 18 years of age. We do not knowingly collect information from or direct any of our content specifically to anyone under the age of 18.

3. License to Use

Subject to your compliance with this Agreement, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on your personal mobile device solely for your personal, non-commercial use.

4. User Responsibilities

You agree to:

• Use the App only for lawful purposes and in accordance with this Agreement
• Not use the App in any way that violates any applicable laws or regulations
• Not attempt to gain unauthorized access to any portion of the App or any systems or networks
• Not interfere with or disrupt the App or servers or networks connected to the App
• Not use any automated system to access the App
• Maintain the security of your account credentials
• Be solely responsible for all content you create and store in the App

5. Intellectual Property Rights

The App and its entire contents, features, and functionality are owned by Hynexis and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain all rights to the content you create within the App (your dream entries, notes, and images). However, you grant us a limited license to process this content solely for the purpose of providing App functionality (such as AI analysis when you request it).

6. In-App Purchases

Hynexis offers in-app purchases, including subscriptions and virtual currency (coins). All purchases are processed through the Apple App Store and are subject to Apple's terms and conditions.

7. Subscriptions

Subscription terms are detailed in our Membership Agreement. By purchasing a subscription, you agree to the terms specified in that agreement.

8. Virtual Currency (Coins)

Coins are virtual currency that can be purchased and used within the App to unlock certain features. Coins have no real-world value and cannot be exchanged for cash. Coins do not expire but may become unavailable if you delete your account.

9. Refunds

All purchases are processed through the Apple App Store. Refund requests must be made through Apple according to their refund policy. We do not have the ability to process refunds directly.

10. Privacy and Data

Your privacy is important to us. Our collection and use of personal information is described in our Privacy Policy. By using the App, you consent to our collection and use of information as described in the Privacy Policy.

11. Content Disclaimer

Hynexis provides tools for dream recording and analysis. The AI-powered interpretations and insights are for entertainment and self-reflection purposes only. They should not be considered as:

• Medical advice or diagnosis
• Psychological counseling or therapy
• Predictions of future events
• Professional mental health services

If you are experiencing mental health concerns, please consult with a qualified healthcare professional.

12. Limitation of Liability

To the maximum extent permitted by law, Hynexis and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use or inability to use the App
• Any unauthorized access to or use of our servers
• Any bugs, viruses, or other harmful code that may be transmitted to or through the App
• Any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content

13. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, secure, or error-free.

14. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for any reason, including if we believe you have violated this Agreement.

You may stop using the App at any time by deleting it from your device. Upon termination, all licenses granted to you will immediately cease.

15. Changes to the Agreement

We may modify this Agreement at any time. We will notify you of any material changes by posting the new Agreement in the App and updating the "Last Updated" date. Your continued use of the App after changes are posted constitutes your acceptance of the modified Agreement.

16. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

17. Dispute Resolution

Any disputes arising out of or relating to this Agreement or the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

18. Severability

If any provision of this Agreement is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that this Agreement shall otherwise remain in full force and effect.

19. Entire Agreement

This Agreement, together with our Privacy Policy and Membership Agreement, constitutes the entire agreement between you and Hynexis regarding the use of the App.
